NAIROBI, Kenya Apr 26 – The Office of the Director of Public Prosecutions (ODPP) has initiated the prosecution of Peter Gitaa Koria, the suspended Chief Executive Officer of Bomas of Kenya, concerning procurement irregularities amounting to Sh8.5 million.
The Ethics and Anti-Corruption Commission (EACC) had in November 2023 recommended the suspension of Koria over alleged irregularities in procurement.
Koria, however, sought legal redress, and on April 2024 the the Employment and Labour Relations Court ordered his immediate reinstatement.
The ODPP however asserts that Koria has a case to answer following EACC investigations.
“The ODPP has made a decision today to charge Koria over procurement irregularities and splitting of tenders leading to irregular awards to suppliers in the Financial Year 2020/2021,” read in part a statement issued by the office.
Koria faces three charges centering on procurement irregularities.
The primary charge accuses Koria of willfully violating procurement laws by initiating procurement processes without an approved budget or procurement plan and neglecting to establish an Ad Hoc Inspection and Acceptance Committee as required by law.
“The ODPP remains committed to executing its constitutional mandate by the rule of law and further, with due regard to the public interest, the administration of justice, and avoidance of abuse of the legal process,” the ODPP said.
