NHIF Board, CEO Face Contempt Charges Over Court Orders Dispute with JOMEC Limited » Capital News
I, Kenya Apr 19 – The board and CEO of the National Health Insurance Fund (NHIF) are facing contempt of court charges for allegedly failing to honor court orders jointly registered with JOMEC Limited earlier this year.
NHIF’s CEO, Elijah Wachira, and the board are named as respondents in the suit filed by Wachira & Mumbi Advocates on behalf of JOMEC Limited.
JOMEC seeks to have Elijah held in civil jail for contempt. High Court Judge Justice Josephine Wayua Wambua Mongare certified the matter as urgent, ordering the respondents to be served and to file responses within seven days. The court also directed a mention for directions on April 22, 2024.
The dispute stems from NHIF’s failure to settle outstanding payments to JOMEC amounting to over Sh188 million, despite a consent agreement reached in January.
NHIF’s refusal to execute new service delivery agreements, as mandated by the consent order, has led to the current legal standoff.
The Penal Notice on the Consent Orders warns of contempt charges for disobeying the court orders.
