Madrassa teacher jailed for 20 years for sexually assaulting student » Capital News
NAIROBI, Kenya, Apr 27 — A Malindi court has sentenced a, Kilifi-based Madrassa teacher to 20 years in jail for sexually assaulting his 15-year-old student.
The Office of the Director of Public Prosecutions (ODPP) stated Friday that the convict stupefied his victim before assaulting him repeatedly on July 29, 2022, at Mambrui in Magarini Sub County within Kilifi County.
The ODPP identified the convict as Yusufu Charo Dole, 25.
“He was convicted with the offence of defilement contrary to section 8[1] as read with section 8[3] of the sexual offences act No 3 of 2006,” the ODPP said.
Chief Magistrate Elizabeth Usui, delivering the verdict, found the prosecution’s evidence sufficient to support the charge against Dole.
The prosecution, led by Counsels Kennedy Kirui and Barack Chirchir, presented four witnesses and exhibits that proved the case against him.
The court heard that, Dole administered a green pill to the minor, when he went to see the him after his victim was taken ill.
“The pill made the boy drowsy and the accused took him to another room where he committed the heinous act,” ODPP stated.
Despite his incapacitation, the victim was able to witness the assault.
The ODPP noted that Dole repeatedly sodomized the minor, causing immense pain and trauma, which prevented the victim from attending classes or speaking to anyone for a week.
The victim eventually confided in a classmate, who informed the institution’s management. Dole disappeared from the institution for a week but was apprehended upon his return.
The court rejected Dole’s defense that he was framed by the headteacher, ruling that he was properly identified by the victim and other students.
Additionally, the court found that the medical evidence corroborated the minor’s testimony.
