JSC condemns use of firearms within court precincts

The Judicial Service Commission (JSC) has condemned the use of a firearm in a court in environment in Ruiru, Kiambu County on Friday.

Several gunshots were fired at the court premises after police officers re-arrested a politician allied to impeached Deputy President Rigathi Gachagua following his release by the court.

According to JSC, the the accused had been released on bond following a court ruling when shortly thereafter, a team of police officers stormed the court premises to re-arrest the accused. During this action, gunfire was discharged within the court precincts, despite the absence of any security threat or civil disorder.

“While the Commission recognises and respects the constitutional mandate of the police to enforce the law and apprehend suspects, the use of firearms in a court environment is excessive, unjustified and an affront to the authority and dignity of the Judiciary,” said the Judicial Service Commission.

“Courts are sacred spaces of constitutional adjudication. They are to be respected, protected and preserved as secure and impartial forums for the administration of justice,” the condemnation statement read.

JSC cautioned the police from using excessive force with in court precincts that may erode the confidence in the institutions charged with the administration of justice.
