Court issues order stopping businesswoman from encroaching on Karen property » Capital News
NAIROBI, Kenya, Mar 15 – The High Court has issued a restraining order stopping a businesswoman and her agents from encroaching on a property located in Karen and measuring 66 acres.
Environment and land Court division judge Ogutu Mboya issued an injunction barring Dorcas Kiptoo from interfering with the suit property in dispute pending the hearing and determination of the matter before the court.
The judge said that the aggrieved applicant, Arvind Kanji Patel has approached the court saying Cheptoo did hire goons who descended upon the land, destroyed the perimeter fence in view of taking possession of the sued property.
The applicant has deponed that Cheptoo has not produced tittle of ownership and it is incumbent upon the court to issue restraining orders to allow the matter heard interpartes for the court to make a decision who is the real owner of the land.
The judge directed that Cheptoo file a response or reply affidavit to the application by the plaintiff applicant and the matter be heard by all parties on March 18.
