Newly formed Advisory Board at AG’s office to hire deputy solicitor-generals » Capital News
NAIROBI, Kenya, Apr 24 – The hiring and remuneration of deputy solicitor-generals and State counsel will now be done by newly formed Advisory Board in Attorney General’s office instead of the Public Service Commission (PSC).
This follows the signing of the Statute Law Amendment Bill, 2024, amending 16 Acts of Parliament, including strengthening the AG’s Office.
In a brief, the national assembly stated that the appointment of the state council by the PSC is often done on unfavorable terms of engagement despite their fundamental role.
It has been pointed out that this has prompted most state counsel working at the office of the AG to be poached by other public institutions
“As it is presently, state counsels are recruited on unfavorable terms of engagement even though they perform unique roles. This necessitated a rethinking of the manner of engagement of the officers including their terms of employment and scheme of service,” it stated.
The national assembly has pointed out that the office of the Attorney General has always lacked the competent personnel to fully deliver its constitutional responsibilities due to poor terms of employment of the officers.
According to the national assembly, the reform will further strengthen the office of the attorney General and enable it to dispense its constitutional mandates effectively.
“For many years, the office of the Attorney General has been characterized by lack of personnel to perform its functions due to poor terms of employment of state counsel and lack of a scheme of service for the officers,” the brief stated.
